1. Information We Collect

We collect information you provide directly to us when you make a purchase, create an account, or otherwise interact with us, including:

  • Profile Data: We collect information or content you provide to us in connection with an account or profile, such as when you register for an account, create a profile or fill out a form. Examples of profile data we may collect include your name, email address, phone number, mailing address, account login name and password, clothing size, preferred language, birthday, and social media names or handles.
  • Personal Identifiers: Name, shipping or billing address, email address, and phone number.

  • Transaction and Payment Information:  We collect transaction information related to the products and services you purchase from us. Examples of information collected include the type of products or services requested or provided, order details, delivery information, amount charged, payment method, billing or shipping information, government-issued identification card (for returns only), measurements in connection with our tailoring services, and information about any products or services you returned or exchanged with us. If you make a purchase, we work with third-party payment processors to collect and process your payment information. We use third-party payment processor Shopify.  We do not store your full credit card details on our servers.
  • Order History: Details of the clothing items you purchased, sizes, and transaction dates.
  • Automated Data: IP address, browser type, and device information collected via cookies.
  • Communications Data: We collect information when you communicate with us or others on our Services, such as when you request additional information about products or services, interact with our customer service team or sign up to receive our email or marketing messages. We also collect communications data when you interact with us on social media, such as by tagging us and/or our products or permitting us to follow your social media profile. Examples of such data may include your contact information, the date and time of your communications, online identifiers, social media profile, and the content of your communications with us.
  • User Content: We collect any other information or content you provide to us, such as when you rate our designs or provide product feedback, make other submissions to us, use any other features of our Services that may be offered from time to time, which may require the collection of certain personal data in order to utilize the features. Examples of user content may include information about your size, fit, goals, opinions, feedback, preferences, text, images, and any other personal data you choose to provide in your interactions with us.
  • Device and Network Data: We collect certain information about the device you use to access our Services. Examples of such data include your device’s hardware model, browser type, IP address, operating system version, language settings, unique device identifiers, advertising identifiers, serial numbers, device motion data, screen resolution, usage and traffic data, how your device interacts with the Services, network information, and mobile network data.
  • Useage Data: We collect information about your activity on our Services via log files, cookies, web beacons, and other tracking technologies. Examples of such data include your access dates and times, pages or screens viewed, how long you spent on a page or screen, the routes by which you access our Services, searches you conduct on the Services, information about your activity on a page or screen, app crashes and other system activity, your use of any hyperlinks available within our Services, information about your interactions with our emails, your Internet service provider (ISP), Mobile Advertising ID, media access control (MAC) address, and identifiers associated with browser cookies, web beacons, and similar technologies we deploy on our Services.
  • Geolocation Data: We collect your precise or approximate geolocation data in accordance with your device permissions. You may use our Services without enabling us to collect location data from your device.
  • Please note that we do Not collect or store biometric information via your use of Touch ID, Finger Print, Face ID Authentication Certain devices are eligible for enrollment in Touch ID®, Face ID® or fingerprint login. Fingerprint/Face ID Authentication is an optional authentication method offered to log in to Mobile App. It is available for iOS devices with Touch ID™ capability and Android devices that have compatible Fingerprint/Face ID support (running Android 6.0 or higher). While Fingerprint/Face ID is a biometric recognition feature, designed, released and trademarked by Apple Inc., we do not collect your biometric information nor store biometric information from you. Your Fingerprint/Face ID is stored on your device when you set up your Fingerprint/Face ID enabled device. Apple, the Apple logo, iPhone, iPad, Apple Watch and Touch ID are trademarks of Apple Inc., registered in the U.S. and other countries. App Store is a service mark of Apple Inc. Google Pay and Android is a trademark of Google Inc. Samsung is a registered trademark of Samsung Electronics Co., Ltd. 

2. How We Use Your Information

We use your data to provide a seamless shopping experience, including:

  • Processing and shipping your orders.
  • Sending order confirmations and tracking updates.
  • Providing customer support and responding to inquiries.
  • Sending marketing communications (if you have opted in). Use for "marketing” means contacting you through means other than telephone (for example, email or postal mail) to offer and market to you services or products, including special offers or advertisements, any of which may be tailored to you.
  • Research and development: We may use your personal information to combine and anonymize information about your interactions with RateFit to create aggregate, anonymized statistics for use in research, education and for marketing, promoting, improving, and developing our platform. We may also conduct data analytics to develop insights about your needs, and your preferences, so we can make more informed predictions, recommendations, and products for our customers.
  • Contests and Sweepstakes. When you participate in contests or sweepstakes, we may share personal data with service providers, partners, or affiliates who assist in contest administration or prize fulfillment for contests and sweepstakes. Contests or sweepstakes are subject to and governed by this Privacy Policy and any other applicable rules or terms of conditions that the relevant third parties post and make available to you. By entering contests or sweepstakes, you agree to provide certain personal information, including but not limited to name and contact details. This information will be collected, stored, and used by the service provider or partner of the contest or sweepstakes, and done for the following purposes:
    - To administer and manage the contest or sweepstakes, including verifying eligibility, contacting winners, and delivering prizes.
    - To communicate updates, promotional offers, or future contests that may be of interest to participants, if they have provided consent.
    - To analyze participation data and improve future marketing and promotional activities.
  • We do not sell or share a participants’ personal information with unaffiliated third parties except as necessary to administer the contest or sweepstakes or as provided by law. All data is handled in accordance with the Privacy Policy and applicable data protection laws of the provider or partner of the contest or sweepstakes. By submitting an entry, you acknowledge and consent to the collection and use of your personal information as described above. You may withdraw consent or request data deletion at any time by contacting the contest or sweepstakes provider or partner as described in its terms of use that it makes available to you.
  • Promotions. We may use personal information to provide promotional programs. We provide these programs in collaboration with third parties who operate their own websites and mobile applications. Each program is subject to and governed by our Terms of Use, this Privacy Policy and any other applicable rules or terms of conditions that the relevant third parties post and make available to you.
  • In addition to the uses described above, to analyze our App, we may use various analytics services, which may independently collect Usage Information, set and access their own tracking technologies, and otherwise collect or have access to non-personally or personally identifiable information about you. We may also use your information for purposes disclosed at the time you provide your information, or with your consent.
  • Improving our website layout and product selection based on browsing trends.

3. Sharing Your Information

We do not sell your personal data. We only share information with third parties necessary to run our store:

  • Service Providers: Logistics partners (e.g., USPS, UPS) and payment gateways.
  • Marketing & Analytics: Tools like Google Analytics to understand site traffic. Third parties may collect non-personal Information when you download or use the App. Some third parties may collect your personal information when you visit the App. We do not control the information collection, use, or sharing practices of third parties, including analytics providers
  • Legal Requirements: we may disclose your information (i) if we are required or permitted to do so by law or legal process, (ii) to law enforcement authorities, or (iii) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspected or actual illegal activity. We also reserve the right to disclose and transfer your information if our Company goes through a business transition, such as a merger, acquisition by another company, sale of all or a portion of its assets, or other corporate change, including during the course of any due diligence process.
  • Information Sharing Non-Personal information: We may also share non-personal Information, such as aggregate user statistics (e.g., number of downloads and registrations, and most popular merchants), demographic information and Usage Information, with affiliates and third parties, including advertisers, content providers, and analytics providers.
  • Information Sharing with our Affiliates: Our Affiliates offer products and services that may be of interest to you. We may share personal information with our Affiliates to provide information to you about their products and services that may be of interest to you.

4. Use of Artificial Intelligence

We are committed to responsible use of Artificial Intelligence (“AI”). We may use AI to process your personal information for purposes including but not limited to determining the product offerings marketed to you, providing communication through virtual chat bots, data analyses, synthesizing documentation and data, performing calculations and any such purposes to enhance your customer experience. We will not engage in such activities without your consent, or unless the processing is necessary for entering into a contract, product or service or for performance of a contract, product or service. Please note the use of automated decision making includes human oversight. When applicable, you also retain the right to request a human instead of automation such as with the use of a virtual chat bot.
We may also use AI-powered tools and products to support us in day-to-day work (e.g. to create summaries, optimize workflows, draft correspondence, translate text or generate images).


5. Your Privacy Rights

Depending on your location, you may have the right to:

  • Access: Request a copy of the personal data we hold about you.
  • Correction: Ask us to update or fix inaccurate information.
  • Deletion: Request that we delete your personal data (subject to legal obligations such as tax records).
  • Opt-Out: Unsubscribe from marketing emails at any time using the "Unsubscribe" link.

6. Cookies and Tracking

Cookies are small pieces of information that a Web site stores on a visitor’s web browser to remind the site about the visitor the next time they visit the site. We do not store sensitive information in cookies. We use cookies to enhance our customers’ online experience for making navigation easier, providing products and providing certain important security features. For example, terminating a session if a customer forgets to log-out. You may be able to control the use of certain cookies by following the instructions set forth in your web browser’s settings. For example, you may be able to set your browser so that it notifies you before accepting a cookie, so that you can control whether you accept or reject a cookie. Each browser is different so check the “help” menu of your browser to learn about how to change your cookie preference. 

We also use cookies to remember your shopping cart and analyze site performance.

7. Choices You Have to Limit Sharing of Online Information 

You may opt-out of certain electronic marketing communications and targeted advertising by clicking the opt-out button below or selecting unsubscribe within any marketing email communication you receive. 

Please note you still may receive communications from us. Your opt-out may only apply to the specific browser or device from which you opt-out. You will need to opt-out separately on all of your browsers and devices. Further, the links provided in this section do not apply to physical mailings, telephone calls, or text. You may also have the choice to limit sharing of online information as described below. 

  • Do Not Track Signals. Some Internet browsers can communicate your privacy preferences to the websites you visit, like, requests not to track your usage and browsing history. Our websites do respond to “do not track” opt-out mechanisms and signals to prevent online advertising to you. We utilize the established industry mechanisms. You can also limit the amount of online advertising you receive by visiting one or both of these examples:

  • Electronic Marketing Communications. You have the choice to tailor how we provide electronic marketing communications to you. You have the option to opt-out, subscribe, or re-subscribe to our marketing communications. There are two ways to unsubscribe from our email marketing communications:

2 . From one of our emails, open the email, towards the bottom of the email, Click the “Unsubscribe” link. Please allow 10 days for the completion of your request. 

3. On some mobile device, Android or iOS phones may have capabilities to limit receiving interest-based advertisements located in your phone’s settings. 

4.  Through advertising industry and trade regulatory agencies, operated by the Network Advertising Initiative or Digital Advertising Alliance and Preferences in Your Mobile Device. You may be able to control other preferences on your mobile device. Your device’s setting may allow you to reject push notification and limit our app’s access to other information on your mobile device. Note, this may result in the loss of app functionality or our ability to provide Online Services to you through a mobile device.

 

8. Data Security

We implement industry-standard security measures, such as SSL encryption, to protect your data. However, no method of online transmission is 100% secure.

11. Notice of Right to Opt-Out of Sale or Sharing

1. Right to Opt-Out

  • Under the California Consumer Privacy Act (CCPA), as amended by the CPRA, California residents have the right to direct a business that sells or shares personal information to stop doing so.
  • "Sale" is defined broadly to include any transfer of personal data to a third party for monetary or other valuable consideration.
  • "Sharing" refers to disclosing personal information for cross-context behavioral advertising (targeted ads based on your activity across different websites).

2. How to Exercise Your Right

  • Web Form: You may submit an opt-out request via our interactive Do Not Sell or Share My Personal Information [insert an embedded link to web form].
  • Email: You can also email your request to Info@RateFit.com with the subject line "CCPA Opt-Out Request".
  • No Account Required: You do not need to create an account with us to exercise this right.
  • Verification: We may ask for basic information (such as your email or order number) to identify your records, but we will not require full identity verification for opt-out requests unless we suspect fraud.

3. Global Privacy Control (GPC)

  • Our website recognizes and honors Global Privacy Control (GPC) signals.
  • If your browser or extension has GPC enabled, we will automatically treat it as a valid request to opt out of the sale or sharing of your personal information for that session.

4. Response Time

  • We will process and honor your opt-out request as soon as feasibly possible, and send an acknowledgement of your request. We may also ask for additional information if necessary to process your request.

 RateFit, LLC (hereinafter “we,” “us,” “our”) is committed to protecting your privacy. This Notice at Collection describes the categories of personal information we collect from you, the purposes for which we use it, and how long we keep it. 

1. Categories of Personal Information We Collect
We collect the following categories of personal information (including sensitive personal information) from you:

  • Identifiers: Name, alias, postal address, unique personal identifier, online identifier, IP address, email address, account name, or similar identifiers.
  • Customer Records: Name, signature, physical characteristics or description, address, telephone number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information.
  • Characteristics of Protected Classifications: Age, race, color, ancestry, national origin, religion, sex, sexual orientation, gender identity, medical condition, marital status.
  • Commercial Information: Records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories.
  • Internet/Network Activity: Browsing history, search history, information on a consumer’s interaction with a website, application, or advertisement.
  • Geolocation Data: Physical location.

California residents also have specific privacy rights provided by the California Consumer Privacy Act (CCPA), as it may be amended from time to time. COLORADO, CONNECTICUT, UTAH, VIRGINIA RESIDENTS
Colorado, Connecticut, Utah, and Virginia law require certain disclosures for companies that "sell" personal information pursuant to the respective state's privacy law. Each state defines the "sale" of data differently. Colorado, Connecticut, Utah, and Virginia define the "sale" of data as a company exchanging personal information for monetary consideration with a non-affiliated third party.
Under Colorado, Connecticut, Utah, and Virginia law, we do not "sell" your personal information.

VERMONT RESIDENTS
If you are a resident of Vermont, we will not share personal information we collect about you with non-affiliates unless the law allows or you provide authorization.

NORTH DAKOTA RESIDENT
If you are a resident of North Dakota, we will not share personal information we collect about you with non-affiliates unless the law allows or you provide authorization.

NEVADA RESIDENTS

SMS Terms for RateFit, LLC
PLEASE READ THESE TERMS OF USE CAREFULLY, as they contain an agreement to arbitrate and other important information regarding your legal rights, remedies, and obligations. The Agreement to arbitrate requires (with limited exception) that you submit claims you have against us to binding and final arbitration. Additionally, (1) you will only be permitted to pursue claims against RateFit, LLC. on an individual basis, not as a plaintiff or class member in any class action or representative action or proceeding; (2) you will only be permitted to seek relief (including monetary, injunctive, and declaratory relief) on an individual basis, and (3) you may not be able to have any claims you have against us resolved by a jury or in a court of law.
Agreement to Arbitrate: This agreement to arbitrate is referred to and these Terms of Use as the “Arbitration Agreement.” You agree that any and all disputes, claims or controversies arising out of or relating to this Arbitration Agreement or the relationship between me, on the one hand, and RateFit, LLC or its parents, subsidiaries or affiliates (collectively “COMPANY”), on the other hand, whether based in contract, tort, statute (including the Telephone Consumer Protection Act and similar federal and state laws and regulations), fraud, misrepresentation or any other legal theory – including, but not limited to, claims relating to my account, RateFit, LLC. products and services and communications from or on behalf of RateFit, LLC. (“Disputes”) – shall be submitted to American Arbitration Association (“AAA”), or its successor, for confidential, final and binding arbitration to be resolved by a single arbitrator in accordance with the terms of this Arbitration Agreement. You further agree that the arbitration will take place on an individual basis, and that by entering this Arbitration Agreement, you and the Company agree to waive any right to a trial by jury and to participate in any class action. For avoidance of doubt, you agree to give up the ability to bring a lawsuit in court (except small claims discussed below); and you are giving up the ability bring or participate in a class action in any form or forum, even if your Dispute is determined not to be subject to arbitration. Your rights will be determined by a neutral arbitrator, not a judge or jury. The Federal Arbitration Act governs the interpretation and enforcement of this Arbitration Agreement.
Prohibition of Class and Representative Actions and Non-Individualized Relief: YOU AND COMPANY AGREE THAT EACH OF US MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION OR PROCEEDING. UNLESS BOTH YOU AND COMPANY AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN MORE THAN ONE PERSON’S OR PARTY’S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CONSOLIDATED, REPRESENTATIVE, OR CLASS PROCEEDING. ALSO, THE ARBITRATOR MAY AWARD RELIEF (INCLUDING MONETARY, INJUNCTIVE, AND DECLARATORY RELIEF) ONLY IN FAVOR OF THE INDIVIDUAL PARTY SEEKING RELIEF AND ONLY TO THE EXTENT NECESSARY TO PROVIDE RELIEF NECESSITATED BY THAT PARTY’S INDIVIDUAL CLAIM(S), EXCEPT THAT YOU MAY PURSUE A CLAIM FOR AND THE ARBITRATOR MAY AWARD PUBLIC INJUNCTIVE RELIEF UNDER APPLICABLE LAW TO THE EXTENT REQUIRED FOR THE ENFORCEABILITY OF THIS PROVISION. THIS ARBITRATION AGREEMENT DOES NOT PRECLUDE YOU FROM BRINGING ISSUES TO THE ATTENTION OF FEDERAL, STATE, OR LOCAL AGENCIES, AND SUCH AGENCIES CAN, IF THE LAW ALLOWS, SEEK RELIEF AGAINST COMPANY ON YOUR BEHALF.

Governing Law: The formation, existence, construction, performance, and validity of this agreement shall be governed by the laws of the State of Illinois and the United States, without reference to choose or conflict of law principles.
What Are Rate Text Messages? RateFit Texting provides an easy way to get alerts from RateFit about promotional and mortgage and payment information from almost any mobile device or cell phone at a number you provide. Messaging frequency varies for each customer.
Will it cost anything? RateFit will not charge you to send or receive text messages from us; however message and data rates may apply depending on the wireless plan that you have with your carrier.
Privacy Policy and Opting In: You agree to RateFit Online and Mobile Application Privacy Notice by granting consent for SMS texting. You can view all applicable privacy policies above. By opting in to SMS texting, you agree to the terms of the online and mobile application privacy notice.
